City Rep. Melina Castro has amended her pleading seeking access to “evaluation letters” related to the settlement of between the city of El Paso and former City Attorney Rita Rodriguez. On the heels of a Texas Attorney General ruling that Castro is entitled to see the documents but must maintain their confidentiality, something the city notes was its position all along, Castro now is seeking a court to force the city to allow her lawyer to review the material with her. She also is asking a court to declare that she has the right to sit in executive session meetings when Council members are discussing her lawsuit against the city.
The Attorney General ruling was Feb. 3, and the city’s lawyers sent Castro a letter Feb. 6 formally offering her a chance to review the documents, which Castro has focused on as key to the case. Castro, through her pleadings, has made it clear she believes the settlement was flawed, and appears to be seeking validation of that argument through the “evaluation letter,” prepared by the city’s outside counsel in the Rita Rodriguez case. The material was only available to Council members in executive session.
